10. Online orders

11. Refusal to order

Exceptional circumstances may occur that imply the refusal to process an online order, even after sending the order confirmation.

Termequip reserves the right to refuse an order for several reasons, namely:

When the order has not been paid within a maximum period of 2 days after its creation;

TERMEQUIP reserves the right to inform the user about the refusal of the order in question and to propose or request alternative resolution solutions. In the absence of a consensual solution or contact with the user, the order will be canceled by TERMEQUIP, with a full refund of the amount paid by the user, to be returned by the same payment method.

12. Delivery of the order

Online order deliveries can be made in two ways: store pickup (Termequip) and home delivery.

In-store pickup:

When placing an order online, the user will be able to request the collection of the products ordered at a Termequip store free of charge, subject to stock availability.

When the item (s) ordered by the user is available for delivery, the TERMEQUIP store will send an SMS to the user, advising him that the order can be picked up at the selected store and date.

If after repeated attempts it is impossible to contact the user to collect the order, the TERMEQUIP store will send to the address provided by the user when ordering, a registered letter with acknowledgment of receipt, granting him a new period of one week to proceed with the order. withdrawal, under penalty of loss of the signal provided and of any right over the item (s) ordered.

Delivery:

TERMEQUIP provides for the delivery of products ordered online, properly packaged, at the address and date indicated by the user for this purpose. The indicated date may change, namely due to unavailability of stock or unforeseen by the carrier, however, TERMEQUIP cannot be held responsible in case the delivery is not satisfied within this period.

The date selected by the user is only valid upon payment when placing the online order. Any delay in payment may result in changes to its processing.

Regarding the delivery of parcels in the Islands, the user has two options to choose from:

Indicate the address of a freight forwarder selected by you, located in Mainland Portugal, and the cost of delivery of the order to the freight forwarder will be the same as that of shipping to an address in Mainland Portugal (the user is responsible for the costs inherent to the service of the freight forwarder), or

Indicate the final address in the Archipelago of the Azores or Madeira, and the cost of delivery of the order corresponds to the journey from a TERMEQUIP store to the indicated address (delivery at home).

TERMEQUIP informs that the average delivery times are as follows (subject to stock availability):

Mainland Portugal: between 2 to 4 working days for normal transport service throughout the country or after 3 am within 50 km of a store for express services (if available)

Islands: from 16 business days for shipping service (without weight limit) or 9 business days for air shipping service (maximum 30kg), with a maximum period of 30 business days for delivery, except for external conditions to TERMEQUIP or carriers, such as weather conditions, strikes, etc.

Depending on the delivery service, the user will be notified by sms or email by the shipping company on the day before the delivery date or on the same day, and can reschedule a new delivery if necessary. TERMEQUIP does not deliver on Sundays or holidays.

If, for any reason, TERMEQUIP is unable to deliver on the scheduled date, the user must be informed accordingly and given the option of choosing a new date or proceeding to its cancellation, with full refund of the amount paid.

Regarding delivery costs, they are variable, calculated according to the type of products ordered and the distance between the destination address and the TERMEQUIP store. The assembly of the articles is not included in the respective cost of delivery, except when the chosen service expressly indicates it (only available for some articles).

The user will be able to consult all the details of the delivery service.

13. Promotional codes and discount vouchers

From time to time, TERMEQUIP may make commercial offers by providing promotional codes. A promotional code will enable the user to take advantage of a promotion related to the purchase of a specific item / service or a set of items / services during the period in which the respective promotional campaign is running.

The promotional code will automatically activate the discount to which it is associated, being immediately reflected in the final amount to be paid by the user, not being able to be exchanged for its cash value.

The use of each code is subject to the specific conditions of the promotional campaign in which it is inserted, so before making an online purchase, the user must check the conditions of the current campaign.

Promotional codes are only valid for purchases made at www.termequip.pt.

15. Warranties

Under the terms of the current legislation, the goods purchased from air conditioning at www.termequip.pt enjoy a legal guarantee of two years, which may be higher when the producer or distributor of the article so guarantees. The number of years of warranty may be specified on the product detail page. However, if the information is missing, it must be assumed that it has a 2-year warranty.

In the event that, during the warranty period, the purchased asset presents any non-conformity or damage, the user should contact our Customer Support service who will inform him of the procedure.

14. Applicable legislation

These General Terms and Conditions of Use are subject to the Portuguese legislation in force at the time. Any conflict or divergence of interpretation will be submitted to the Portuguese court with jurisdiction.
